En la sentencia, el magistrado juez Miguel Aramburu apunta que el agente, \u00abconsciente de la situaci\u00f3n de riesgo de su compa\u00f1ero, a quien no pod\u00eda auxiliar, ya que \u00e9l estaba situado en el exterior de la vivienda, y dado que no ten\u00eda otro medio para evitar la agresi\u00f3n y el riesgo que representaba para la vida de su compa\u00f1ero, sac\u00f3 su pistola\u00bb. As\u00ed, a\u00f1ade que \u00abr\u00e1pidamente, cuando consider\u00f3 que pod\u00eda hacer un disparo con la finalidad de herir \u2013al m\u00fasico\u2013, le dispar\u00f3 para impedir que continuara agrediendo su compa\u00f1ero\u00bb.
